The appraisal council is responsible for evaluating and appraising the conditions for environmental monitoring service activities of the organization applying for certification. This evaluation is based on assessment results, a review of application documents, and on-site inspections at the organization.
According to Circular No. 02/2022/TT-BTNMT issued by the Ministry of Natural Resources and Environment, which provides guidance on the implementation of certain provisions of Decree No. 08/2022/NĐ-CP dated January 10, 2022, and the Law on Environmental Protection 2020, the appraisal process for environmental monitoring service conditions is outlined in Article 49 of this Circular as follows:
1. Review of the application for certification of eligibility for environmental monitoring service activities:
a) After receiving the appraisal fee, the certification-granting agency shall review and evaluate the application of the organization applying for certification of eligibility for environmental monitoring service activities based on the conditions stipulated in Article 91 of Decree No. 08/2022/NĐ-CP.
b) The certification-granting agency sends the application of the organization to the appraisal council members for review and study before conducting on-site inspections and evaluations.
2. Appraisal of conditions for environmental monitoring service activities:
This process is carried out through an appraisal council established by the head of the certification-granting agency as per the provisions in Form No. 01, Appendix IV, issued with this Circular.
The appraisal council evaluates the organization’s eligibility for environmental monitoring service activities based on assessment results, application reviews, and on-site inspections.
3. On-site inspection and evaluation at the organization:
a) Inspection content: The appraisal council assesses the organization’s compliance with the conditions specified in Article 91 of Decree No. 08/2022/NĐ-CP and compares it with the submitted application for certification of eligibility for environmental monitoring service activities.
b) Inspection results: The results of the on-site inspection must be documented in a report and submitted to the appraisal agency for record compilation. The appraisal council’s report after the on-site inspection is considered an integral part of the appraisal file.
4. Organizing the appraisal council meeting:
The appraisal council meeting is held after the on-site inspection results are available and the certification-granting agency has received the organization’s fully supplemented and corrected application in accordance with the requirements stated in the on-site inspection report.
5. Issuance of certification:
Based on the appraisal results, the head of the assigned appraisal agency submits the recommendation to the Minister of Natural Resources and Environment for the issuance or amendment of the certification of eligibility for environmental monitoring service activities. If the organization fails to meet the certification requirements, the head of the appraisal agency shall follow the provisions of Point c, Clause 3, Article 93, or Point c, Clause 4, Article 94 of Decree No. 08/2022/NĐ-CP.
